Confused by the US Tax System?

Please note that the information below only applies if you're both a non-US citizen and a non-US resident. If you're either of the above, this information does not apply to you.

There are three important things to remember during filing season:

1. Filing taxes in the US does not mean that you have to pay taxes. It only means that you have to submit and report your business profits/losses for the year.

2‍. You’re required to pay taxes on U.S sourced income. Your income is considered “U.S. sourced” if any of the following are true:

  • You have a physical business location in the U.S.
  • You have full time employees in the U.S.
  • You visited the U.S. and stayed more than 30 days in total in the past year

3. Single members and multi-member LLCs have different filing requirements. Select one of the options below to learn more.

I'm a single member LLC owner

Single member LLCs that do not have U.S. sourced income (see point 2 above) are not required to pay a percentage of their revenue as taxes to the IRS. You only pay our service fee for preparing, filing and faxing your tax returns.

We file prepare and file forms 5472 and 1120 signed electronically, and faxed to the IRS on your behalf.

Once the fax is sent, your tax filing process is complete. The IRS does not send a fax confirmation from their office, but the fax service confirms that the fax is delivered to their fax number.

As a multi-member LLC owner, it means there are at least two persons that are listed as members in your company.

Each member registered in the LLC will need an ITIN. ITIN applications are a separate service and cost $550 per person. The ITIN application needs to be done only once. After the ITIN is issued, it will be used each subsequent year for filing your taxes.

As a multi-member LLC, we will file the following:

  • Form 1065 (U.S. Return of Partnership Income): This is the annual tax return for the LLC itself. It reports the business’s income, deductions, gains, and losses.
  • Schedule K-1 (Form 1065): Each member receives a Schedule K-1, which details their share of the LLC’s income, deductions, and credits. Members use this information to report on their personal tax returns.
  • Form 8832 (optional Entity Classification Election): If the LLC chooses to be taxed as a corporation (C-corp or S-corp) instead of a partnership, it must file Form 8832. If electing S-corp status, Form 2553 is also required.
  • Form 1120: The LLCs that elect to be taxed as a C-corp, file Form 1120. This document is filed and sent with the Schedule K-1

Please note that you will need to pay a percentage of your business profits as taxes to the IRS. We will provide instructions on how the IRS receives the tax payment and provide a secure portal for sending the amounts.

Yes, you MUST file a tax report each year.

Even if you have $0 in transactions, as long as your LLC is active (not closed) you must file your taxes each year.

Please note that your federal taxes/returns is different from the state annual report.

Both are filed annually, however, the federal tax returns are sent to the IRS while the state reports are sent to the state where your company was registered.
